Terms of Service

These Terms of Service ("Terms") govern your access to and use of FirstPick.AI ("Service", "we", "us", "our"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Description of Service

FirstPick.AI is a subscription-based job search automation service delivered via Telegram. The Service monitors company job boards, matches new job postings to your profile, delivers job alerts hourly, and generates AI-tailored CVs in PDF format. Automated form-filling ("auto-apply") is available for certain ATS platforms.

2. Eligibility

You must be at least 16 years old to use this Service. By using the Service, you represent that you meet this age requirement and that all information you provide is accurate and complete.

3. Account Registration

Your account is linked to your Telegram identity. You are responsible for maintaining the confidentiality of your activation token and for all activities that occur under your account. Notify us immediately at firstpick.ai@gmail.com if you suspect unauthorized use of your account.

4. Subscription and Billing

  • The Service is offered at $29 USD per month after a 7-day free trial.
  • Billing is processed by Paddle (paddle.com), our authorized reseller and Merchant of Record. Paddle handles all payment processing, invoicing, and tax collection. By subscribing, you also agree to Paddle's Terms of Service.
  • Your subscription renews automatically each month until cancelled.
  • You may cancel at any time via the /account command in the bot, which provides a link to your Paddle customer portal. Cancellation takes effect at the end of your current billing period — you retain access until then.
  • We reserve the right to change pricing with at least 30 days' notice to active subscribers.

5. Free Trial

New accounts receive a 7-day free trial. No credit card is required during the trial period. At the end of the trial, you must subscribe to continue receiving alerts and CV generation. Unused trial features do not carry over.

6. Acceptable Use

You agree not to:

  • Share your activation token or account access with other people ("key sharing"). We monitor for multiple simultaneous activations and will suspend accounts that violate this policy.
  • Use the Service to submit false or misleading information on job applications.
  • Attempt to reverse-engineer, scrape, or otherwise extract the underlying job data or codebase.
  • Use the Service for any unlawful purpose or in violation of any applicable laws.
  • Resell, sublicense, or commercially redistribute the Service or any output from it.

7. Intellectual Property

The Service and all underlying technology, including our job-matching algorithms, CV generation pipeline, and user interface, are the exclusive property of FirstPick.AI. You retain ownership of your personal CV content and profile data that you provide to us.

AI-generated CV output produced by the Service is licensed to you for personal, non-commercial use. We claim no ownership over the final PDF documents generated for your job applications.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not guarantee that you will receive job offers, that alerts will be delivered without interruption, or that AI-generated CVs will pass any particular ATS system. Job search outcomes depend on many factors beyond our control.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FIRSTPICK.AI AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE AMOUNT PAID BY YOU TO US IN THE THREE MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

10. Termination

We reserve the right to suspend or terminate your account at our sole discretion if we determine you have violated these Terms, engaged in fraudulent activity, or for any other reason with reasonable notice. Upon termination, your right to use the Service ceases immediately. Refund eligibility upon termination is governed by our Refund Policy.

You may terminate your account at any time by cancelling your subscription and contacting firstpick.ai@gmail.com requesting account deletion.

11. Changes to Terms

We may revise these Terms from time to time. Material changes will be communicated via Telegram or email at least 14 days before they take effect. Continued use of the Service after changes constitutes acceptance of the revised Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with applicable law. Any disputes arising from these Terms or the Service shall be resolved through good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration.
